Am I Owed Overtime Pay?

Federal law requires employers to pay non-exempt hourly employees 1.5x their normal pay (i.e., “time and a half”) for each hour over forty that they work in a work week. For example, if you are normally paid at the rate of $20 per hour, you must be paid $30 per hour for every hour over 40 you work in a week. This is called overtime. Employers who refuse to pay overtime face strict penalties for their failure to comply with the law. Often, the determination as to whether an employee is exempt is a complicated one. Or, sometimes it is difficult to calculate the actual pay owed, especially if an employee is paid a commission or non-discretionary bonus.
